General Terms and Conditions

  1. General

The General Terms and Conditions of Online Shopping are drawn up in accordance with the Consumer Protection Act (ZVPot, Official Gazette of the Republic of Slovenia, No. 98/2004-UPB2, 126/2007, 86/2009, 78/2011), the Electronic Commerce on the Market Act (ZEPT, Official Gazette of the Republic of Slovenia, No. 96/2009-UPB2), the Code of Obligations (OZ, 97/2007-UPB1) and the international e-commerce codes. The Privacy Policy, which complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR"), can be found at at this link.

The online shop literaskaligrafija.si (hereinafter also referred to as "the shop") is operated by the company Literas kaligrafija, Zlatka Trstenjak Rampre s.p., Ulica za mlinom 7,1380 Cerknica, registration number: 6458394, tax number: 71221948, which is also a provider of e-commerce services (hereinafter also referred to as "the Seller" or "Literas kaligrafija, Zlatka Trstenjak Rampre s.p.")

The General Terms and Conditions of Business determine the operation of the literaskaligrafija.si online shop, the rights and obligations of the user and the shop, and regulate the business relationship between the literaskaligrafija.si online shop and the buyer.

 

  1. Payment methods

Literas Calligraphy, Zlatka Trstenjak Rampre s.p. sends an invoice for the purchase in e-form, or on request as an attachment in the package of ordered products. The invoice shall include a breakdown of the price and all costs related to the purchase, as well as a notice of the right to withdraw from the contract.

It is the Buyer's responsibility to verify the accuracy of the information before placing an order. We will not consider any subsequent objections to the correctness of invoices.

When shopping online, the provider offers the following payment methods:
- Pay Pal and credit card payments.

When enquiring via the online form or at info@literaskaligrafija.si and, once the order has been confirmed, payment can be made on account by bank transfer to a business account;

The supplier shall issue an invoice on a durable medium (paper) or to the e-mail address provided by the customer at the time of order, with an itemised breakdown of the costs. The notice to the Buyer of the possibility to withdraw from the Contract and the procedure for returning the goods are covered by the General Terms and Conditions.

  1. Prices

All prices are expressed in euro (EUR) and do not contain VAT pursuant to Article 94 The Law on value added tax (ZDDV-1) - we are not subject to VAT. Prices do not include delivery charges. All prices are valid at the time of order placement and have no pre-determined validity and are therefore valid only until changed from time to time.

 

  1. Payment of postage

The amount of postage is fixed at EUR 6,50.

 

  1. Purchase procedure

Technical steps to concluding a sales contract

The following technical steps are available to the user (buyer) during the purchase process:

log in to the online shop or log in using your email address, or log in with your Facebook and Google account,
- search for a product in the product range in the online shop,
- selecting a product to buy,

  • a selection of product features, including a choice of different designs and colours for additional personalisation.

determining the quantity of a product to buy in your shopping basket,
- adding the selected product to your shopping basket,
- view the price of the selected product in the selected quantity
- selecting how the product will be delivered (see also point 4.),
- choice of payment method (see also point 2.),
- an overview of the order, including the delivery method chosen and the delivery charges, if any; and
- confirmation and award of the contract, thus completing the purchase (see also points 3.3 and 5.4).

 

  1. Technological means to identify and correct errors before awarding a contract

The user of the online shop (customer) is given the opportunity to identify and correct errors before placing an order:

sees which products have been selected and added to your basket,
see the price of each product and the total price of the entire quantity selected for each product,
modifies the selected quantity of each product and calculates the new amount of the modified quantity,
removes selected products that it does not wish to purchase from the basket; and
Before confirming the order, the user (customer) can change the delivery method and the payment method.

 

  1. Order accepted

After placing an order, the user (buyer) receives an email from the provider informing him/her that the order has been accepted. Within 1 hour of receiving this notification, the user (buyer) has the option to cancel the order. Except for the cancellation option, the user (buyer) cannot change the content of the order after the order has been placed. The user (buyer) shall always have access to comprehensive information on the status and content of each order in his/her profile on the provider's website.

Upon receipt of the order, the supplier shall inspect and check the deliverability of the products ordered. If certain products are out of stock, the Supplier shall inform the Buyer and agree with the Buyer on a new delivery date or a change to the order. At this stage, the purchase contract between the user (buyer) and the supplier for the purchase of the products ordered is irrevocably concluded (see point 7).

 

  1. Dispatch of goods

The provider prepares and dispatches the ordered products within the agreed deadline and notifies the user (buyer) by e-mail.The products are delivered by our business partners Pošta Slovenije, d.o.o. and DPD, kurirska in paketna distribucija, d.o.o. In case you wish to choose a different delivery date, please inform us by e-mail: info@literaskaligrafija.si or make a comment before placing your order. We use the service of the Post of Slovenia to send the bottles Handling with greater care and wine logistics DPD companies.

 

  1. Delivery method and deadline

Ordering a calligraphic reproduction

The Supplier undertakes to dispatch the products ordered as quickly as possible. Most orders received by 12.00 noon on a working day are dispatched within three (3) working days in the case of reproductions that are in stock. In the event that a particular product is out of stock or you would like additional personalisation on the product and delivery will take longer than three (3) working days, we will inform you immediately by telephone or email. Again, for the sake of such notifications, we kindly ask you to enter accurate information when logging in.

 

  1. Ordering original calligraphic prints

For orders of original calligraphic prints, the supplier makes every effort to accommodate the customer in the production and dispatch process, if the customer wants a product for a special occasion or as a gift and it is particularly important that they receive it on time or within the specified deadline. The product shall be agreed between the supplier and the customer. The Supplier does not guarantee that the products will be dispatched on time if it has not received all the necessary information requested by the Customer (text, choice of font, colour, format, occasion, etc.) For products with a text of more than 60 words or 340 characters with spaces, the delivery time is 20 days after receipt of all the necessary information. Calligraphic products made to order are produced by the supplier only after payment of the invoice.

 

  1. Order a calligraphically engraved bottle

Orders for calligraphically engraved bottles are subject to dispatch within seven (7) working days. As this is a personalised product with a message to your liking and as we engrave by hand, it takes some time to produce. Based on your personalised message and choice of calligraphy style, the text needs to be adapted to the size and shape of the bottle and the wine bottle label needs to be taken into account. The engraving is coated or filled with a permanent paste according to the colour of the label. Two colours are possible, silver or gold. You can also order a gift sleeve for the bottle and receive a ready-made gift.

When ordering, please note that, unlike computer-generated text, the beauty of calligraphy lies in the variation of the shape and layout of the letters. The calligrapher's hand will not make the letters exactly the same every time, which is what makes calligraphy such a special and unique work of art.

 

  1. Order engraved sparkling wine

Engraving on sparkling wines, champagnes or other bottles that are filled under pressure is discouraged and only done in exceptional cases. Calligraphic writing in pen is recommended for bottles under pressure. When ordering an engraved sparkling wine, the customer should bear in mind that it is a product that is filled under pressure, so we rarely engrave sparkling wines and champagnes on special request. For the safety of the customer and the safety of the supplier at work, it is important that the bottle retains its physical characteristics. Calligraphic engraving on sparkling wines and champagnes is therefore only possible as monoline or single-line engraving. This means that the engraving machine is not used to spread the strokes in order to create broad vertical strokes, as is possible on a bottle that is not filled under pressure. Such broadened strokes imitate a calligraphic pen, which produces a broad longitudinal stroke because it is split in the middle and thus produces a broad stroke. In engraving, this is created by multiple strokes, thus effectively imitating calligraphic writing. This is not provided by the supplier for champagne and champagne except in cases of small quantities of text.

 

  1. Order perfume engraving

When ordering an engraving, the buyer should note that not all perfumes are suitable for engraving. The Supplier does not guarantee that engraving will be possible, therefore, when purchasing or ordering a perfume, the Customer should ensure that at least one surface of the bottle is flat where engraving will be possible. Bottles which are engraved, cut or coated with the appearance of cut glass are unsuitable and will be returned to the purchaser. Engraved fragrances will be delivered to our studio within three (3) days of collection.

 

  1. Order a personalised product

When ordering a product with personalisation, where the customer enters text of his/her choice, the provider reserves the right to refuse to carry out the personalisation if it finds that the messages are malicious, discriminatory, offensive, indecent, vulgar, defamatory, hateful, threatening, obscene, or any other content that may damage the reputation of the provider or other users of this online shop.

 

  1. Engraving at the event or at the client's location

Conclusion of a specific contract

A calligraphy or calligraphy engraving client can hire a provider for various promotional events suitable for wineries, caterers, drugstores, perfumeries, companies or event organisers. Live calligraphy requires a specific contract based on the points herein

General Conditions 16 to 20.

 

  1. Advance payment and booking

Booking a calligraphy or live calligraphy engraving appointment and payment in advance for a minimum of four (4) hours of engraving is required. The Customer may cancel the service at least 14 days prior to the performance to secure a 100 % refund of the purchase price. Cancellation seven (7) days prior to the event shall be entitled to an 80 % refund of the purchase price.

 

  1. Provision of a workstation

The client shall provide a table and chair in a well-lit area. The supplier needs a table for the arrangement of already coloured or engraved products to be collected by the customer's guests or customers. Calligraphy and calligraphic engraving shall not require an electrical connection. For calligraphic engraving, the client uses a quiet, small table-top machine without the use of an additional compressor, which does not disturb the visitors. Only the contact with the material is audible, which is not disturbing or noisy.

In the case of a dimly lit room or a deliberately dark room, the Client shall provide the electrical connection and the Supplier shall provide its own suitable lighting for the work that does not interfere with the Client's ambience. The Provider shall also select, in agreement with the Client, a suitable wardrobe that is as coordinated as possible and appropriate to the presentation of the Client's event, such as the black colour of clothing in perfumeries. The Provider shall have the right to display its business name on the workstation and to offer its business cards and other promotional material.

 

  1. Contact person of the client

The client provides a contact person who also takes care of communication with customers and visitors at the event itself, and accepts products for engraving.

 

  1. Consumables

The customer provides engraving products for their customers or event guests. The customer shall choose products made of glass, crystal or metal for calligraphic engraving. The Customer acknowledges that cut glass, glass with a frosted coating that flakes or etched glass without flat surfaces (certain perfumes) or rough cut metal are not suitable for calligraphic engraving. The supplier may, at the request of the customer, pre-inspect or even test engrave the products. The supplier shall ensure that the workstation is arranged in a suitable way to make it as attractive as possible for the customer. All materials, tools and other consumables shall be provided by the supplier. The promotion of the event shall be provided by the client.

 

  1. Quantity of engraved products per hour

The provider can provide calligraphic writing and engraving of individual items on suitable materials in a few minutes, but the work may be slowed down by the actual communication with customers, which is part of a successful shopping experience and customer event.

 

  1. Your order - Contract concluded

The contract of sale between Literas kaligrafija, Zlatka Trstenjak Rampre s.p. and the buyer is concluded in the online shop literaskaligrafija.si at the moment when Literas kaligrafija, Zlatka Trstenjak Rampre s.p. From that moment, all prices and other terms and conditions are fixed and apply to both Literas kaligrafija, Zlatka Trstenjak Rampre s.p. and the Buyer. The Buyer is the person with the details as stated at the time of placing the order. No subsequent changes to the Buyer's details are possible.

For distance contracts, the consumer has the right (under distance or off-premises contracts) to inform the company within 14 days that he or she is withdrawing from the contract, without having to give a reason for his or her decision. In doing so, the consumer may only be charged the costs referred to in Article 43d(7) of this Consumer Protection Act - ZVPot-1:

A distance contract is a contract concluded between a business and a consumer on the basis of an organised distance selling or service provision system without the simultaneous physical presence of the contracting parties (sales by internet, post, telephone, fax, etc.) up to and including the moment of conclusion of the contract.

The period for withdrawal from a sales contract starts on the day on which the consumer acquires actual (physical) possession of the goods (receipt of the goods). Of course, the consumer has the option to withdraw from the contract before acquiring physical possession of the goods.

The buyer can thus by notify the provider of the withdrawal by email info@literaskaligrafija.si  or to Literas calligraphy, Zlatka Trstenjak Rampre s.p., Ulica za mlinom 7, 1380 Cerknica.

 

  1. When does a consumer have no right of withdrawal?

Unless otherwise agreed by the parties, the consumer has no right of withdrawal referred to in the first paragraph of this Article for these contracts:

  • goods which are manufactured according to the consumer's precise instructions and tailored to his personal needs; it follows from Article 43d that:

 

The 14-day cooling-off period does not apply to goods and products made to order. 

  • the supply of digital content which is not delivered in a tangible medium, where the provision of the service has been initiated on the basis of the consumer's prior express consent and with the understanding that he or she thereby loses the right of withdrawal (online course)

If the Buyer has already received the Goods and withdraws from the Contract, the Buyer must send the Goods back to the Seller undamaged and in the same quantity within 14 days of the notice of withdrawal, unless the Goods have been destroyed, damaged, lost or reduced in quantity through no fault of the Buyer.

The address for returning the goods to the Seller is Literas calligraphy, Zlatka Trstenjak Rampre s.p., Ulica za mlinom 7, 1380 Cerknica. Please return the product in its original packaging. The product must be unopened, undamaged and in unaltered condition. The buyer must enclose the invoice or a copy thereof with the returned products.

The Provider shall return all payments made to the Buyer without delay and no later than fourteen (14) days after receipt of the notice of withdrawal, but the Provider may extend the time limit for the refund if it has not received the returned goods or proof that the goods have been sent within that time. The Provider will refund the payment by transfer to your personal bank account (you must inform us of this during the refund process). The Provider does not pay cash. The only cost charged to the buyer in connection with withdrawal from the contract is the direct cost of returning the goods - postage.

The Buyer may also return goods that have been destroyed or damaged in transit. In this case, the Supplier shall replace the product at its own expense. In the event that the damage to the consignment caused by transport is visible, the Buyer may reject such consignment immediately upon delivery.

The Purchase Contract (i.e. the first e-mail about the status of the order) is stored electronically on the literaskaligrafija.si server.

 

  1. Invoicing

Literas Calligraphy, Zlatka Trstenjak Rampre s.p. sends the purchase invoice electronically or as an attachment in the package of ordered products. The invoice shall include a breakdown of the price and all costs relating to the purchase and a notice of the right of withdrawal.

It is the Buyer's responsibility to verify the accuracy of the information before placing an order. We will not consider any subsequent objections to the correctness of invoices.

 

  1. Further clarifications on the purchase

Under the Code of Obligations, the buyer is obliged to take delivery of the ordered package and pay the redemption fee. If the Buyer does not take delivery of the goods ordered, which are sent COD, in any case, and the goods are returned to the Company's address after a waiting period of fifteen (15) days at the post office, this shall NOT be considered as a withdrawal from the Contract, as the latter is still validly concluded and it is a unilateral unannounced withdrawal of the Buyer from the Contract. If the Buyer does not accept the package, this action causes financial damage to the Company. In the event of non-acceptance, the Buyer is therefore liable for the costs of shipping and return of the products to the Company, for which the Seller will invoice the Buyer, which the Buyer is obliged to pay, as the Buyer has not terminated the contract. In the event of non-payment of the invoice, the matter shall be settled by means of a claim. Receivables are handled by an external company. In the case of fraudulent orders, the IP address will be handed over for further processing as abuse. The cost of non-collection is EUR 15,00 and includes administration, packaging, shipping and return shipping costs.

The Buyer shall be bound by the General Terms and Conditions in force at the time of purchase (placing an online order). The User shall be specifically reminded at the time of placing an order of the following general terms and conditions and, by placing an order, confirm that they are aware of them.

 

  1. Right to privacy

The Provider undertakes to permanently protect all personal data against loss, misuse or unauthorised access in accordance with the Personal Data Protection Act (PDPA). The data will only be used for communication with the User. Based on your consent, we will use your personal data and data related to the provision of services and products exclusively to send you information materials, offers, invoices and to communicate with you - marketing and news through various means of communication. In no case will the user's data be passed on to a third party.

 

  1. Business security

The operator of this online shop uses appropriate technological and software tools to protect the transmission and storage of personal data and payments. The online shop is protected by an SSL certificate. Secure Sockets Layer (abbreviated SSL) is a cryptographic protocol that enables secure communication on the Internet, for example when browsing the Web and during e-mail communication, where there is a need to transmit data of a confidential nature (e.g. personal data and credit card numbers).

It is also the user's responsibility to ensure the security of their username and password, and to ensure that their computer is properly protected by software and anti-virus.

  

  1. Accessibility to information

The online shop literaskaligrafija.si undertakes to provide the following information to the buyer before he is bound by the contract or the offer:

the information about the company Literas calligraphy, Zlatka Trstenjak Rampre s.p., Ulica za mlinom 7, 1380 Cerknica , 6458394 (company name and registered office, registration number),

contact details that allow the user to communicate quickly and efficiently (email, phone),

the essential characteristics of the items and the period of validity of this information,

availability of items (every item offered on the website should be available within a reasonable time),

the terms of delivery of the goods (and the method, place and time of delivery),

the prices, which must be clearly and unambiguously set out, showing whether they already include taxes and transport and other charges, and the period of validity of this information,

the method of payment and delivery or performance, and the period of validity of this information,

the time validity of the offer,

the period within which the contract may be withdrawn from and the conditions for withdrawal (description of the right of withdrawal in accordance with Article 43c of the Consumer Protection Act; in cases where the consumer does not have a right of withdrawal in accordance with Article 43c of the Consumer Protection Act, the consumer shall be expressly informed of this),

an explanation of the complaints procedure, including full details of the contact person or customer service.

 

  1. Protection of personal data

Literas calligraphy, Zlatka Trstenjak Rampre s.p. is committed to the permanent protection of all personal data of the user in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 and ZVOP-1.

The User must be aware that he/she is obliged to provide the Online Trader with his/her personal data in a correct and truthful form and to inform the Online Trader of any changes to his/her data. By accepting these Terms and Conditions, the User confirms that the personal data provided by him/her is correct.

 

  1. Exclusion of liability

The Provider accepts no liability for any consequences arising from the use of the online shop and its contents, including any material or immaterial damage. It is the user's responsibility to use the content in the online shop in a reasonable manner for his/her own highest good.

Although the online shop is protected by SSL, there is a possibility of abuse of the online shop, which is beyond the control of the provider. For this reason, the provider excludes liability in the event of the transmission of malicious software that could be installed on the device from which the user accesses the online shop. The Provider advises users to educate themselves on this subject and to protect their devices against the risk of malware being downloaded.

Although the Supplier endeavours to ensure that the information in the online shop is accurate and up-to-date with the utmost care, there is a possibility that, due to the multiplicity of products or rapid changes in information, the information on the items, delivery times, price or other information may be different from what is stated in the online shop or may be incomplete due to the multiplicity of products or rapid changes in information. It is the user's responsibility to verify the information if there is any suspicion of incorrect or incomplete information. We reserve the right to change product information including photographs and any other related information without prior notice.

The Provider shall not be liable for the intermittent inoperability of the online shop, any inaccuracy of the information in the online shop or for any damage caused by the inaccessibility, use or inability to use the information in the online shop.

In the event that the user has ordered an item with incorrect or incomplete information, the provider will notify the user and allow the user to cancel the order. If, after placing the order and before receiving the item at home, the user discovers that the item has incorrect information, he/she is obliged to report the error in the online shop and the provider will allow him/her to cancel or replace the order.

The provider is actively working on updating the photos in the online shop, so all images should be taken as symbolic. Some of the features of the item in the picture do not reflect the actual condition of the items (e.g. the size of the item in the picture).

The Provider is not responsible for the content of comments made by users in the online shop. The Provider may reject comments that contain manifest untruths, misleading facts or content that is offensive to other users or the Provider itself.

The Provider reserves the right to make substantive and other changes to the General Terms and Conditions and to amend them at any time and in any manner, for any reason and without prior notice.

The Provider reserves the right to change the sales offer in the online shop without prior notice. The Provider shall use its best endeavours to ensure that the information published on the website is up-to-date and correct. However, in individual cases, the supplier may not be able to deliver the product to you because it is sold out and out of stock. However, the characteristics of the items, the delivery date or the price may change so quickly that the supplier is unable to correct the information on the website. In such a case, the supplier will inform the buyer of the changes and give the buyer the opportunity to withdraw from the order or to exchange the ordered item.

 

  1. Complaints and disputes

The Provider complies with applicable consumer protection laws and regulations. Objections, comments, claims and declarations may be sent by e-mail to info@literaskaligrafija.si or by post to Literas calligraphy, Zlatka Trstenjak Rampre s.p., Ulica za mlinom 7, 1380 Cerknica. The hearing procedure is confidential.

The Supplier undertakes to acknowledge receipt of the complaint to the Customer within 5 working days at the latest, to inform the Customer of the time taken to process the complaint and to keep the Customer informed of the progress of the procedure. The Supplier shall use its best endeavours to resolve any disputes amicably. If no amicable settlement is reached, the Cerknica District Court shall be the exclusive court for the settlement of all disputes between the Provider and the User (Purchaser). The Provider and the User (Purchaser), as participants in electronic commerce, mutually acknowledge the validity of electronic messages in court.

These General Terms and Conditions of Business and any disputes between the Provider and the User (Customer) shall be governed by and governed by the substantive and procedural law of Slovenia, without the application of rules of private international law that would indicate the application of any other law.

The provisions of the Code of Obligations, the Electronic Commerce Act, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis to all relationships and rights and obligations not governed by these General Terms and Conditions.

 

  1. Out-of-court settlement of consumer disputes

In accordance with the legal norms, Literas Calligraphy, Zlatka Trstenjak Rampre s.p. does not recognise any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute that a consumer may have initiated in accordance with the Act on the Out-of-Court Settlement of Consumer Disputes.

Literas kaligrafija, Zlatka Trstenjak Rampre s.p., which as a provider of goods and services facilitates online trade in the territory of the Republic of Slovenia, publishes on its website an electronic link to the platform for online resolution of consumer disputes (SRPS). These rules are based on the Law on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.
